1. Agreement to Terms
Sincey (the “app”) is made by Everminimal Studio, L.L.C. (“we”, “us”). By downloading or using the app, you agree to these Terms and to Apple's Licensed Application End User License Agreement (the “Standard EULA”). If the two conflict, the Standard EULA applies. If you do not agree, please do not use the app.
2. The App
Sincey helps you count the days since past events and until future ones. The app works without an internet connection. Only What's New and the feedback board need one.
3. Your Entries
What you add to Sincey is yours. It is stored only on your device, as described in the Privacy Policy. We do not keep a copy, so we cannot recover it for you.
Keep a backup, for example with iCloud Backup. If you delete the app, or lose or reset your device without a backup, your entries are gone for good.
4. Premium
Premium is a one-time in-app purchase from the App Store. It is not a subscription and does not renew. The price is shown before you buy.
Apple handles payment, and refunds are requested from Apple under its policies. To use Premium on another device signed in to the same Apple Account, tap Restore purchases.
5. Free Trial
The free trial unlocks everything in Premium for 24 hours and costs nothing. When it ends, anything you chose during the trial goes back to its free version, and nothing is charged. The trial is offered again 30 days after your last one started.
6. Reminders
Reminders are delivered as notifications by iOS, and depend on your notification settings, Focus and device. We cannot guarantee they arrive, so please do not rely on Sincey alone for anything important, such as medication, legal or payment deadlines.
7. Acceptable Use
Please do not copy, modify, reverse-engineer, resell or redistribute the app, except where the law allows it. The app, its name, design and content belong to Everminimal Studio, L.L.C.
8. Third-Party Services
Some features open or rely on services we do not run: the App Store, GitHub for What's New, and Sleekplan for the feedback board. Their own terms and privacy policies apply, and we are not responsible for them.
9. Updates and Availability
We may update, change or stop offering the app. Significant changes will be noted in the app's What's New. Some updates may be needed to keep using certain features.
10. No Warranty
To the extent the law allows, the app is provided “as is” and “as available”, without warranties of any kind, including that it will be error-free or uninterrupted.
11. Limitation of Liability
To the extent the law allows, we are not liable for indirect or consequential losses, including lost entries or missed reminders. Our total liability to you is limited to the amount you paid for the app in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Nothing in these Terms takes away rights you have under the consumer protection laws of the country where you live.
13. Changes to These Terms
We may update these Terms. When we do, we will change the effective date above and note significant changes in the app's What's New. Continuing to use the app after that means you accept the updated Terms.
