Everminimal Studio, L.L.C.(“Everminimal Studio”, “we”, “us”, or “our”) operates the website everminimal.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our website or contact us. Please read it carefully. If you disagree with its terms, please stop using the site.
Scope: This policy covers the everminimal.com website only. Our mobile applications are governed by their own separate privacy policies, which are linked from each app’s App Store listing and support page. This policy does not apply to them.
Your use of this website is also governed by our Terms of Service.
This policy is designed to meet the requirements of the General Data Protection Regulation (GDPR) for users in the European Union and European Economic Area, the UK GDPR and Data Protection Act 2018 for users in the United Kingdom, the California Online Privacy Protection Act (CalOPPA) and California Consumer Privacy Act (CCPA) for California residents, the Texas Data Privacy and Security Act (TDPSA), and Canada’s Anti-Spam Legislation (CASL) and Personal Information Protection and Electronic Documents Act (PIPEDA) for Canadian residents.

We are an independent software studio. We have not appointed a Data Protection Officer (DPO), as we do not engage in large-scale systematic monitoring or large-scale processing of special-category data, and are therefore not required to do so under GDPR Article 37.
We have not appointed an EU representative under GDPR Article 27. Our processing of EU residents’ data is occasional, limited to inquiries and newsletter subscriptions that individuals initiate themselves, does not involve special categories of data on a large scale, and is unlikely to result in a risk to your rights and freedoms — which we understand to fall within the Article 27(2) exemption. We only collect personal information you actively provide to us, together with the limited technical data described in Section 2.4. We do not use tracking cookies, advertising pixels, or analytics services.

We store your light/dark mode preference in your browser’s localStorage. This data never leaves your device and is not transmitted to our servers.
Like nearly all websites, our hosting and infrastructure providers automatically generate technical logs when you visit. These may include your IP address, browser user-agent string, the pages requested, and timestamps. We use this data solely to keep the site running, to diagnose errors, and to detect and block spam, automated abuse, and denial-of-service attempts against our contact and newsletter forms.
We do not use this data to build a profile of you, to track you across websites, or for any advertising purpose. We do not attempt to identify individual visitors from it. These logs are generated and retained by our providers under their own retention schedules, typically 30 days or less.

We do not use your information for automated decision-making or profiling that produces legal or similarly significant effects.
Our service providers may process your data in the United States. Transfers from the EU/EEA and the UK to the United States are covered by Standard Contractual Clauses (SCCs), the UK International Data Transfer Addendum, or equivalent safeguards adopted by each provider, together with supplementary technical measures including encryption in transit and at rest.
By using our website, you acknowledge that your information may be transferred to and processed in countries outside your own. You may request a copy of the relevant safeguards by contacting us.

Depending on where you live, you have the following rights regarding your personal data.
We do not sell or share your personal information. We do not sell your data, share it for cross-context behavioral advertising, or otherwise monetize it. There is nothing for you to opt out of.
Do Not Track (CalOPPA): Our website does not track visitors across third-party websites and does not use behavioral advertising. Because we do not engage in the tracking that Do Not Track signals are designed to prevent, we do not respond differently to DNT browser signals.
Note that we do not currently meet the applicability thresholds of the California Consumer Privacy Act. We honour these rights as a matter of policy regardless.
Texas residents have rights to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising, sale of personal data, and certain profiling. We do not engage in any of those activities. We believe we qualify as a small business as defined by the U.S. Small Business Administration and are therefore largely exempt from the TDPSA; we honour these rights as a matter of policy regardless.
Email us at hello@everminimal.com with the subject line “Privacy Request”. We will respond within 30 days, or within the timeframe required by applicable law, and will tell you if we need a reasonable extension.
We may need to verify your identity before processing your request — usually by confirming that you can access the email address associated with the data. We will not ask you for more information than is necessary to do this.
If you use an authorized agent to submit a request on your behalf, we may ask for proof of that authorization.
If we decline to act on your request, we will tell you why. You may appeal that decision by replying to our response, or by emailing hello@everminimal.com with the subject line “Privacy Appeal”. We will respond to your appeal within 45 days with a written explanation of our reasoning.
If your appeal is denied, you may contact your state attorney general to submit a complaint. For Texas residents, complaints may be filed with the Office of the Texas Attorney General.
EU/EEA residents:If you believe we have not adequately addressed your concern, you have the right to lodge a complaint with the supervisory authority in your member state (for example, the CNIL in France, the Garante in Italy, or the Datenschutzbehörde in Austria).
UK residents:You may lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk.
Canadian residents: You may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

No system is 100% secure, and we cannot guarantee absolute security. In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours where required, and will notify affected individuals without undue delay where the risk is high.
If you discover a security vulnerability, please disclose it responsibly to hello@everminimal.com. We will acknowledge your report and will not pursue action against good-faith security research.
Our website is not directed at children, and we do not knowingly collect personal information from them.
